Yep. This is gonna be fun, once again.
As if they were really going to make $2 million per month by selling 3d prints… that’s absurd!
The only reason I can think of why Stratasys lost that case is that they didn’t even turn up to court. Otherwise, the judgement makes no sense at all.
@Paul_Gross Yes, it appears that Stratasys literally didn’t care enough to show up in court.
@Ryan_Carlyle Perhaps Stratasys are playing a game here. If they appeal, it forces the case into a higher court, costing the litigants much more money to proceed further.
One would assume that the lawyers for Stratasys know what they are doing in this situation…
Another alternative explanation for Stratasys’ no show: sometimes the accountants get involved in the bean counting exercise and determine that the cost of discovery and defense exceeds any potential penalty and the company just cuts their losses. Stratasys may be more focused on financial statements than helping establishing legal principles/precedents.
They didn’t show because it was in small claims court. In the us small claims is done without a lawyer and means nothing if you have no physical presence in the state you are sued in. This is why they sued for 12k
The Thingiverse page has wordings like “By downloading this thing, you agree to abide by the license: Creative Commons - Attribution - Share Alike” for what that matters. It probably had similar wording back then too. I may be a little behind on this story though.
Wait, so… how did Stratasys get dragged into this in the first place?
@Ryan_Carlyle they own the thingiverse website through their acquisition of makerbot back in the day
I am not sure, but they may have closed the account of the people due to violation of terms. It has been quite a while, so I am not sure. They would certainly have a right to.
